Terms of Use

We are Tara Games, a company with registered address at 27, Ewhayeodae 3-gil, Seodaemun-gu, Seoul ("Tara Games", "We" or "Us"). We publish games and mobile-game applications (collectively, our "Games"), available through app stores such as the Apple App Store and Google Play Store (collectively, the "Services").
As a precondition for using the Services, you must agree to these Terms of Use ("Agreement"). By downloading, installing, or otherwise accessing any of our Games, you agree to be bound by this Agreement and by our Privacy Policy. If you do not agree, you may not use or access the Services.
Unless otherwise specified for a particular Game, the Services are free to download and use but may include in-app features that allow you to make purchases.
1. About
1.1 By downloading or using any of our Games, you accept this Agreement and the Privacy Policy. Your relationship with Tara Games is governed solely by these two documents. Both are available for download on our website and via the link above.
1.2 Each time you download a Game, a new Agreement is formed that applies to your use of that Game. If you do not agree to this Agreement and our Privacy Policy, you may not use or access the Services.
1.3 App stores and platforms (e.g., Apple, Google) may impose their own terms on you; those are separate from this Agreement.
1.4 You represent that you are at least 16 years old. If you are under 18, you may play our Games only if your parent or legal guardian has read this Agreement and allowed you to download and play under these terms. Tara Games may require proof of identity, age, and parental consent at any time.
1.5 You represent that you access our Games solely as a private individual. Any commercial use is prohibited.
2. End-User License Agreement
2.1 License
Subject to this Agreement, Tara Games grants you a non-transferable, non-exclusive license to:
- (a) Use each downloaded copy of a Game for your personal, non-commercial enjoyment; and
- (b) Copy the Game files solely for the purpose of downloading, installing, and executing the number of copies authorized by the download site, on mobile devices that you own or control (the "License").
2.2 Restrictions
The rights granted under Section 2.1 are subject to these restrictions:
- (a) You shall not license, sell, rent, lease, transfer, assign, distribute, host, or otherwise commercially exploit any Game.
- (b) You shall not modify, translate, adapt, merge, create derivative works of, disassemble, decompile, reverse compile, or reverse engineer any part of any Game, except to the extent expressly prohibited by applicable law.
- (c) You shall not access any Game to build a similar or competitive service or application.
- (d) No part of any Game may be copied, reproduced, distributed, republished, downloaded, displayed, posted, or transmitted in any form or by any means, except as expressly permitted in this Agreement.
- (e) You shall not remove or alter any copyright notices or other proprietary markings contained on or in any Game.
Any future releases, updates, or other additions to functionality (including in-app items, additional levels, and gameplay enhancements) are governed by this Agreement unless different terms accompany those additions. All copyright and proprietary notices must be retained on any copies.
2.3 Local Laws: You alone are responsible for complying with all applicable laws, including export and import regulations, when using our Games.
2.4 Modifications: Tara Games reserves the right to modify, suspend, or discontinue any Game (in whole or in part) at any time, with or without notice. You agree that Tara Games will not be liable for any modification, suspension, or discontinuation of any Game.
2.5 Ownership: Games are licensed, not sold, to you. Tara Games (and its licensors) own all rights, title, and interest, including intellectual property rights, in and to all Games (excluding any User Content, as defined below). This Agreement does not convey any rights of ownership. All Tara Games names, logos, and product names are trademarks of Tara Games (or its licensors). No right or license is granted to use them by implication or otherwise. Tara Games and its licensors reserve all rights not expressly granted.
2.6 Ads: A Game may display ads when you start, stop, or during gameplay (e.g., banners, interstitials, rewarded videos).
3. User Content
3.1 Definition
"User Content" means any content (text, images, audio, video, or other material) that you upload, share, or otherwise provide within any Game. You are solely responsible for your User Content, including any legal liability that may arise from it. You assume all risks of using your User Content, including third-party reliance on its accuracy, completeness, or usefulness, and any disclosure that may render you or a third party identifiable.
3.5 Acceptable Use Policy
You agree not to use any Game to upload, distribute, or otherwise provide any User Content that:
- (a) Violates any third-party right (copyright, trademark, patent, trade secret, moral right, privacy, publicity, or any other proprietary right).
- (b) Is tortious, defamatory, false, or intentionally misleading.
- (c) Is harassing, abusive, threatening, harmful, vulgar, obscene, or offensive; contains pornography, nudity, graphic violence, or promotes violence, racism, discrimination, bigotry, hatred, or physical harm.
- (d) Is harmful to minors in any way.
- (e) Constitutes unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or similar content.
- (f) Violates any law, regulation, or contractual obligation.
You agree not to use any Game to:
- (a) Upload or distribute any computer viruses, worms, malicious code, or any software intended to damage or alter a system or data.
- (b) Collect information or data regarding other users, including email addresses, without their consent (e.g., using bots, scrapers).
- (c) Disable, overload, impair, or otherwise interfere with Tara Games's or any network's servers (e.g., denial-of-service attacks).
- (d) Attempt to gain unauthorized access to any Tara Games system or network (e.g., password mining).
- (e) Interfere with another user's use of any Game.
4. Term and Termination
4.1 This Agreement runs indefinitely from the date you first accept it.
4.2 Either party may terminate this Agreement at any time by giving 14 days' written notice (including by email). You also may terminate immediately by deleting the Game from your device or removing it from your Facebook apps.
4.3 If Tara Games reasonably believes you have materially breached these Terms, we may suspend your access to any Game and/or terminate this Agreement immediately. Breach of Section 2 (License) or Section 3.5 (Acceptable Use) is a material breach.
4.4 Tara Games may terminate for cause immediately, without notice, if you materially breach these Terms.
4.5 Upon termination, you lose access to the terminated Game, and your in-game progress and related data will be deleted. If Tara Games later continues to offer that Game, you may download or access it again under a new Agreement—but prior data cannot be restored.
5. Indemnity
You agree to defend, indemnify, and hold harmless Tara Games (and its suppliers) from and against any claims, suits, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) brought by third parties arising from or related to:
- (i) Your use of any Game,
- (ii) Your User Content, or
- (iii) Your violation of this Agreement.
Tara Games may assume exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate. You may not settle any matter without Tara Games's prior written consent. Tara Games will use reasonable efforts to notify you of any such claim, action, or proceeding.
6. Third Parties
6.1 Application Stores
The availability of our Games depends on the third-party app stores (e.g., Apple, Google). This Agreement is between you and Tara Games, not the app store. The app store is not responsible for Games, their content, maintenance, support, or any claims related thereto. You agree to pay any fees charged by the app store. Your license is conditioned on your compliance with the app store's terms. The app store (and its subsidiaries) are third-party beneficiaries and can enforce this Agreement.
6.2 Third-Party Services
Tara Games may allow certain third-party applications (e.g., leaderboards, social networks) to provide content through a Game ("Third-Party Services"). When you use a Third-Party Service via our Game, Tara Games may share information with that service as described in our Privacy Policy. Tara Games does not control Third-Party Services and is not obligated to review or endorse them. You access and use all Third-Party Services at your own risk, and their terms and policies apply when you do so.
7. Disclaimers
7.1 AS-IS and AS AVAILABLE
Games are provided "as-is" and "as available." Tara Games (and its suppliers) expressly disclaim all warranties or conditions of any kind, whether express or implied, including warranties or conditions of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, or non-infringement. Tara Games makes no warranty that any Game:
- (a) Will meet your requirements;
- (b) Will be available uninterrupted, timely, secure, or error-free; or
- (c) Will be accurate, reliable, complete, legal, or safe.
7.2 Some jurisdictions do not allow exclusion of implied warranties, so the above disclaimer may not apply to you.
8. Limitation of Liability
8.1 In no event shall Tara Games (or its suppliers) be liable to you or any third party for any lost profits or any indirect, consequential, exemplary, incidental, special, or punitive damages arising from or relating to this Agreement or Tara Games's Privacy Policy, any Game, even if Tara Games has been advised of the possibility of such damages. Use of any Game is at your own discretion and risk; you are solely responsible for any damage to your device or loss of data. Notwithstanding anything to the contrary, Tara Games's liability to you for any damages arising from or related to this Agreement or our Privacy Policy (for any cause whatsoever and regardless of the form of action) will always be limited to the amount you have paid Tara Games, if any, in the prior 12 months.
8.2 Some jurisdictions do not allow limitation or exclusion of liability for incidental or consequential damages; if so, the above limitation may not apply and you may have other rights.
9. Fees
9.1 In-App Purchases
Tara Games may offer virtual goods ("Virtual Items") for purchase with real currency or earned through gameplay. Virtual Items are licensed to you on a limited, personal, non-transferable, non-sublicensable, and revocable basis, for non-commercial use only. Tara Games may manage, control, modify, or eliminate Virtual Items at any time, with or without notice.
All in-app purchases are final and non-refundable, except where required by law. You acknowledge that Virtual Items are delivered immediately upon purchase, and you forfeit any right of withdrawal once performance has begun. Tara Games is not required to provide refunds for any reason; you will not receive money or compensation for unused Virtual Items if your data is erased or you stop using a Game.
9.2 Subscriptions
Some parts of the Services may be subscription-based ("Subscription(s)"), granting ongoing access to content or services. Subscriptions may be offered at various fees for specified periods ("Subscription Period"). Payment is charged through the platform (App Store or Google Play) when you confirm the Subscription via the Game's interface. Subscriptions auto-renew unless you turn off auto-renewal at least 24 hours before the current period ends.
10. Miscellaneous
10.1 Changes to this Agreement: We may revise this Agreement occasionally. If we make substantial changes, we will notify you by prominently posting notice on our website or via email. Any changes become effective 30 calendar days after notice. They apply immediately to new users. Continued use of our Games after such notice indicates your acceptance of the revised terms.
10.2 Notice: Any notice to Tara Games under this Agreement should be sent to taragames.official@gmail.com.
10.3 Severability: If any provision of this Agreement is held invalid or unenforceable, the remaining provisions remain in full force and effect. The invalid provision will be deemed modified to the extent necessary to make it valid and enforceable.
10.4 Entire Agreement: This Agreement, together with the Privacy Policy, constitutes the entire and exclusive agreement between you and Tara Games concerning the subject matter hereof, superseding all prior or contemporaneous agreements.
11. Apple App Store Additional Terms and Conditions
If you access a Game via the Apple App Store, the following additional terms apply. Where these terms conflict with the rest of this Agreement, the more restrictive Apple terms govern, but only regarding Games from the Apple App Store.
11.1 Acknowledgment: Tara Games and you acknowledge that this Agreement is between Tara Games and you only, not Apple. Tara Games is solely responsible for the Game and its content.
11.2 Scope of License: The license granted to you is limited to a non-transferable license to use the Game on an iOS device you own or control, as permitted by Apple's Usage Rules in the App Store Terms of Service.
11.3 Maintenance and Support: Tara Games is solely responsible for providing maintenance and support for the Game, as specified here or required by law. Apple has no obligation to provide any maintenance or support.
